Custody
Material your customer can fetch at any time — no trigger event, no release procedure, no objection. Nobody else offers this.
Protection scope:Operating material
Escrow answers the question 'what if they fail'. Custody answers a different one: 'what if we just need the operations manual on a Tuesday'. The Beneficiary asks, and within five business days it is handed over. We tell you about it, but telling you is not a condition and does not hold it up. A trigger event is irrelevant here, and so is an objection — there is none.
Custody is not escrow, and it does not weaken it. The two Modules are legally independent: separately agreed, separately invoiced, separately terminable. A retrieval leaves the Escrow Module untouched, and a trigger event leaves Custody untouched.
What typically goes in
- Operations manual and runbooks
- Architecture and interface documentation
- The third-party component register with licenses
- Configuration and environment descriptions
- Acceptance and test documentation
How it comes back out
- 01
Your customer asks for the material. No reason, no evidence, no trigger event.
- 02
Within five business days it is handed over, with its checksums.
- 03
We tell you about it. Telling you is not a condition and does not hold it up.
What we owe — and what we don't
We owe
- The pull at the agreed frequency
- Encrypted storage at the agreed location, inside the EEA only
- A checksum over each package and each file
- A dated record of every pull to both parties
- The notices
- Running the release procedure to the letter
We do not owe
- That the material is complete, correct, current or authentic
- That it builds, runs or is free of defects or malware
- That it fits the purpose the beneficiary has in mind
- That third-party rights in it exist or are transferable
Every escrow agent's terms say this. Most of them say it on page nine. It is the whole reason Verification exists as a product you can buy.

FAQ
Common questions.
Can the supplier stop a retrieval?
No. There is no objection procedure. We notify the supplier, but the notice is not a condition and does not delay the handover.
Can Custody be agreed without Escrow?
Yes. The two Modules are separately agreed, separately invoiced and separately terminable.
Does a retrieval affect the escrow?
No. A retrieval leaves the Escrow Module untouched, and a trigger event leaves Custody untouched.
